Fee Structure and Administrative Costs

All fees, costs, and administrative expenses are determined in accordance with the official SCECA Schedule of Fees and Costs, as approved by the Centre.

To promote clarity and effective financial planning, SCECA may provide the parties with a preliminary estimate of costs at the outset of the proceedings.

Such costs may include, without limitation:

  • Registration Fees
  • SCECA Administrative Fees and Expenses
  • Fees and Expenses of the Arbitral Tribunal
  • Fees of any Tribunal Secretary, where applicable

Basis of Calculation

SCECA’s administrative fees, together with the fees and expenses of the arbitral tribunal, are principally calculated based on the amount in dispute.

Claims Counterclaims Set-offs

This methodology ensures a fair, proportionate, and transparent fee structure that appropriately reflects the value, complexity, and nature of the dispute.

Cases of Indeterminate or Exceptional Value

  • The amount in dispute cannot reasonably be determined
  • The amount in dispute exceeds USD 100,000,000
  • The complexity and technical nature of proceedings
  • The time, effort, and resources involved
  • The legal and factual scope of the dispute
  • Additional material circumstances
